利用規約 Terms of Use

1. 本規約の適用

本規約は、HIKYAKU（以下「本アプリ」）の利用に関する条件を定めるものです。本アプリをダウンロードまたは使用することにより、本規約に同意したものとみなされます。

2. サービスの概要

本アプリは、ケトジェニック・断食のライフログアプリです。不定時法に基づく時計、補食スケジュール、東海道チャレンジ、AI解析レポート、血液検査データの分析、生化学インタラクティブ図解等の機能を提供します。

3. 医療に関する免責事項

本アプリは医療機器ではなく、医療行為を提供するものではありません。

  • 本アプリが提供するAI解析レポート、食事写真の栄養推定、血液検査データの分析は、あくまで情報提供・教育目的であり、医学的な診断、治療、処方の代替となるものではありません。
  • 血液検査データの解析結果は「精密栄養学」の観点に基づく参考情報です。健康上の懸念がある場合は、必ず医師または資格を持つ医療専門家にご相談ください。
  • ケトジェニックダイエットや断食は、持病をお持ちの方（糖尿病、摂食障害、妊娠中の方等）にはリスクを伴う場合があります。実践にあたっては医師にご相談ください。
  • サプリメントガイドの情報は一般的な教育目的であり、特定の疾患に対する効果を保証するものではありません。

4. AI解析に関する注意事項

  • AI解析（食事写真、血液検査、週次レポート等）はAnthropic社のClaude APIを利用しています。AIの出力は常に正確であるとは限りません。
  • 食事写真からの栄養素推定値は概算であり、実際の値と異なる場合があります。
  • 血液検査の数値読取（PDF/画像からのOCR）は誤読の可能性があります。重要な判断には元の検査結果を直接ご確認ください。

5. サブスクリプションと課金

  • 本アプリは無料機能と有料機能（Premiumサブスクリプション、ブートキャンプ）を提供します。
  • Premiumサブスクリプションは月額または年額で提供され、Apple App Store経由で課金されます。
  • サブスクリプションは現在の期間が終了する24時間前までにキャンセルされない限り、自動的に更新されます。
  • キャンセルはApp Storeのサブスクリプション管理画面から行えます。キャンセル後も現在の期間が終了するまで機能をご利用いただけます。
  • ブートキャンプは一括購入型のプログラムです。プログラム開始後の返金は原則としてApple App Storeの返金ポリシーに従います。

6. 東海道九十日行（ブートキャンプ）

  • ブートキャンプの合否判定は血液検査のBefore/After比較に基づきます。判定基準は予告なく更新される場合があります。
  • 飛脚認定（通行手形）は180日間有効です。認定の維持にはPremiumサブスクリプションの継続が必要です。
  • 血液検査は利用者自身の責任で手配するものとし、本アプリは検査の精度・正確性について責任を負いません。

7. ユーザーの責任

  • 本アプリで記録・入力したデータの正確性は利用者の責任です。
  • 血液検査データのアップロードにあたっては、本人のデータのみを使用してください。
  • 本アプリを利用して得た情報に基づく健康上の行動は、すべて利用者自身の判断と責任において行ってください。

8. 知的財産権

本アプリのデザイン、コード、コンテンツ（生化学インタラクティブ図解、東海道宿場イラスト等を含む）に関するすべての知的財産権は、開発者に帰属します。個人利用の範囲を超える複製・転載・改変は禁止します。

9. 免責事項

  • 本アプリは「現状有姿」で提供されます。明示または黙示を問わず、特定目的への適合性、正確性、完全性について保証しません。
  • 本アプリの利用により生じたいかなる損害（健康被害、データ損失、経済的損失等を含む）についても、法律で認められる最大限の範囲で責任を負いません。
  • AI解析の結果に基づく行動から生じた損害について、開発者は責任を負いません。
  • 第三者サービス（Anthropic、Apple、iHerb等）の障害・変更により本アプリの機能が影響を受ける場合がありますが、これについて保証するものではありません。

10. サービスの変更・終了

開発者は、事前の通知をもって、本アプリの機能を変更・停止・終了する権利を留保します。サブスクリプションの有効期間中にサービスが終了する場合、残余期間に相当する返金について合理的に対応します。

11. 準拠法と管轄

本規約は日本法に準拠し、日本法に従って解釈されます。本規約に関する紛争は、東京地方裁判所を第一審の専属的合意管轄裁判所とします。

1. Acceptance of Terms

These Terms of Use govern your use of HIKYAKU (the "App"). By downloading or using the App, you agree to be bound by these terms.

2. Description of Service

The App is a ketogenic and fasting lifestyle application. It provides features including a variable-hour (koku) clock, snack scheduling, the Tokaido challenge, AI-generated analysis reports, blood test data analysis, and interactive biochemistry diagrams.

3. Medical Disclaimer

The App is not a medical device and does not provide medical services.

  • AI analysis reports, meal photo nutrition estimates, and blood test data analysis are provided for informational and educational purposes only. They are not a substitute for medical diagnosis, treatment, or prescription.
  • Blood test analysis results are reference information based on a "precision nutrition" framework. If you have health concerns, consult a physician or qualified healthcare professional.
  • Ketogenic diets and fasting may carry risks for individuals with certain conditions (diabetes, eating disorders, pregnancy, etc.). Consult your doctor before beginning any dietary protocol.
  • Supplement guide information is for general education and does not guarantee efficacy for any specific condition.

4. AI Analysis Limitations

  • AI features (meal photos, blood tests, weekly reports, etc.) use Anthropic's Claude API. AI outputs are not guaranteed to be accurate at all times.
  • Nutrition estimates from meal photographs are approximations and may differ from actual values.
  • Blood test value extraction (OCR from PDF/images) may contain reading errors. For important decisions, always refer to the original lab results directly.

5. Subscriptions and Billing

  • The App offers free features and paid features (Premium subscription, Bootcamp).
  • Premium subscriptions are available monthly or annually, billed through the Apple App Store.
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
  • Cancellations can be made through the App Store subscription management screen. Features remain available until the end of the current billing period.
  • The Bootcamp is a one-time purchase program. Refunds after program initiation are subject to Apple's App Store refund policy.

6. The Ninety-Day Trial (Bootcamp)

  • Bootcamp pass/fail determination is based on a before-and-after comparison of blood test markers. Criteria may be updated without prior notice.
  • The Hikyaku Pass (certification) is valid for 180 days. Maintaining certification requires an active Premium subscription.
  • Blood tests are arranged by the user at their own expense and responsibility. The App assumes no liability for the accuracy of external lab results.

7. User Responsibilities

  • You are responsible for the accuracy of data you record or input in the App.
  • When uploading blood test data, use only your own results.
  • Any health-related actions taken based on information obtained through the App are at your own judgment and risk.

8. Intellectual Property

All intellectual property rights in the App's design, code, and content (including interactive biochemistry diagrams, Tokaido station illustrations, etc.) belong to the developer. Reproduction, redistribution, or modification beyond personal use is prohibited.

9. Limitation of Liability

  • The App is provided "as is." No warranties, express or implied, are made regarding fitness for a particular purpose, accuracy, or completeness.
  • To the maximum extent permitted by law, the developer shall not be liable for any damages (including health-related harm, data loss, or financial loss) arising from use of the App.
  • The developer is not liable for damages resulting from actions taken based on AI analysis outputs.
  • App functionality may be affected by outages or changes in third-party services (Anthropic, Apple, iHerb, etc.), for which no guarantee is provided.

10. Changes and Termination

The developer reserves the right to modify, suspend, or discontinue the App's features with prior notice. If the service is terminated during an active subscription period, reasonable refund arrangements will be made for the remaining period.

11. Governing Law

These terms are governed by and construed under the laws of Japan. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
